§ 173-1. Definitions. 

For the purpose of this chapter, the following terms shall have the meanings indicated:
SWIMMING POOL – Any artificial pool or structure intended for wading, bathing or swimming purposes, made of concrete, masonry, metal or other impervious material, over twenty-four (24) inches in depth and which is so constructed that any portion of said artificial pool or structure is located below grade at any point, as measured from the land immediately adjacent to the outside edge of said artificial pool or structure.

§ 173-2. Applicability. 

This chapter is not intended to apply to any artificial pools or structures which are so constructed as to be completely above ground as measured from the land immediately adjacent to the outside edge of said artificial pool or structure.

§ 173-3. Fencing requirements. 

A. No person or persons shall maintain a swimming pool, as defined above, within the confines of the Village of Windsor without first safeguarding such swimming pool with a permanent, protective fence, said fence to be installed so as to encompass the entire perimeter of the swimming pool. Said fence shall be structurally sound, durable and must be maintained in such condition. Said fence shall be a minimum of forty-eight (48) inches in height and shall be of wooden or metal construction. If said fence is constructed of wood, it must be so constructed that there are no open spaces exceeding two by forty-eight (2 x 48) inches. If said fence is constructed of metal, it must be so constructed so as not to have a linkage of more than two (2) inches in diameter.
B. The entrance gate or gates shall have a self-latching device and, except for ingress and egress to and from the swimming pool area, must be kept closed at all times.

§ 173-4. Penalties for offenses. 

Any person convicted of violating any of the provisions of this chapter shall be subject to a fine set forth in Appendix C of the Code of the Village of Windsor containing the list of Fines and Penalties for the Village or imprisonment for fifteen (15) days, or both, and each week that the situation is not rectified from the date of notification shall constitute a separate additional offense.*
