§ 52-1. Legislative intent. 

It is the intent of the Village of Windsor as an exercise of its police power to promote the general health, safety and welfare of the residents of the village by enacting this chapter, since it is the finding of the Village Board that the possession of open containers containing alcoholic beverages by persons on certain public lands, except under controlled conditions, is detrimental to the health, safety and welfare of the residents of the Village of Windsor, in that such possession contributes to the development of unsanitary conditions and the creation of a nuisance.

§ 52-2. Definitions.

For the purposes of this chapter, the words listed below are defined as follows:
ALCOHOLIC BEVERAGE – Includes alcohol, spirits, liquor, wine, beer, cider and every liquid or solid, whether or not patented, containing alcohol, spirits, wine or beer and capable of being consumed by a human being.
CONTAINER – Any bottle, can, glass or other receptacle which is suitable for or used to hold any liquid.
PUBLIC LANDS – Any public highway, street, sidewalk, park, public building, playground or parking area..
VILLAGE – The incorporated Village of Windsor.

§ 52-3. Prohibited activities.

No person shall drink, otherwise consume or have in his or her possession any open container containing any alcoholic beverage on any public land within the village.

§ 52-4. Exceptions; permits.

The foregoing prohibition shall not apply when a permit or license has been issued by the Village of Windsor or other appropriate agency for the public use of any land for any authorized function, including but not limited to fairs, parades,
block parties, field days and carnivals.

§ 52-5. Submission of requests for permits.

Request for permits pursuant to § 52-4 shall be submitted to the Village Clerk, who shall, on the first Tuesday of every month, submit all such requests to the Village Board for review and approval.

§ 52-6 Penalties for offenses.

Any person committing an offense against any provision of this chapter shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine set forth in Appendix C of the Code of the Village of Windsor containing the list of Fines and Penalties for the Village.*
