ARTICLE I
Open Burning; Interference; Fire Limits

§ 93-1. Open burning, penalties for offenses. 

A. No person shall set fire to or burn or cause to set fire to or burn wastepaper, rubbish or any inflammable material within fifty (50) feet of a building used for a store or business purposes and constructed in whole or in part of wood or other inflammable materials, unless the wastepaper, rubbish or inflammable material is burned in a can or similar receptacle made of iron or wire, which is completely covered with a top of similar construction so as to prevent pieces or particles from blowing away; nor shall any person or persons build a bonfire in the village unless it is attended to by a person of at least sixteen (16) years of age; and in no event shall a bonfire be made except between the hours of sunrise and sunset. No leaves or other material shall be burned in the streets.
B. Any person violating any of the provisions of this section shall be liable to a penalty set forth in Appendix C of the Code of the Village of Windsor containing the list of Fines and Penalties for the Village or imprisonment of not more than fifteen (15) days, or both, for any offense.*

§ 93-2. Interference with personnel or equipment; penalties for offenses. 

A. On the approach of any vehicle or apparatus of the Fire Department answering to an emergency or fire call and while sounding a siren, horn or bell, the driver of any vehicle, other than a vehicle of the aforesaid Department or an ambulance on an emergency call, shall immediately drive as close as possible to the right-hand curb and stop and shall not follow after said vehicle or apparatus until the same shall be at least three hundred (300) feet away. No other vehicle, except by direction of the Chief of the Fire Department, shall approach or park within five hundred (500) feet of any such fire apparatus or police vehicle responding to such emergency or fire call after said apparatus or vehicle shall have arrived at its destination.
B. No person shall drive a vehicle so as to impede or obstruct the operation of progress of any fire apparatus or vehicle of the Fire or Police Department or any official or employee in the discharge of official duty.
C. No person shall interfere with any member of the Fire Department in the discharge of his duty, nor shall any person drive upon any hose or other apparatus belonging to the Fire Department, nor drive through or within the established fire lines except with the consent of or by the direction of the Chief of the Fire Department, his assistant or member of such Fire Department in charge of any fire. The provisions of this subsection shall not apply to an ambulance in case of emergency, nor to any vehicles of the Fire or Police Department, public utilities and the United States Mail.
D. No unauthorized person shall enter any fire engine house, hose house or other place where fire apparatus is kept or do any injury to any property belonging to or connected with the Fire Department or, at any time or place, mutilate, damage or interfere with or remove any part of said fire apparatus, trucks, tools, materials or building.
E. No person, except a member of the Police Department or public official or a member of the Fire Department, in the performance of his duty, shall climb on, jump upon or attempt to ride upon a moving fire truck or fire apparatus on its way to or returning from a fire.
F. It shall be lawful for any member of the Police Department, public official in the performance of his duty or the Fire Chief, his assistant or the member of such Fire Department in charge of any fire to remove and take away any vehicle which may be liable to obstruct or impede the prompt and efficient operation of the Fire Department at any scene or site of a fire.
G. No person shall willfully and designedly make or raise a false cry of fire or order or cause to be sounded a false alarm of fire.
H. Any person violating any of the provisions of this section shall be liable to a penalty not exceeding two hundred fifty dollars ($250) or imprisonment for not more than fifteen (15) days, or both, for any offense.

§ 93-3. Fire limits; permission required for construction. 

This section shall be deleted in its entirety. [Amended 9-4-2001; L.L.#5-2001]

ARTICLE II
Fire Hydrants

§ 93-4. Permit required for disturbance. 

All street hydrants are under control of the village. No person shall use a wrench for opening hydrants except one furnished by the village. No person except an authorized agent or employee of the village or of the Fire Department or street cleaning employees of the village or a person holding a written permit signed by the Mayor shall disturb any hydrant or any part thereof or take any water therefrom under any circumstances whatsoever.

§ 93-5. Responsibility for damages. 

In case any damage to a street hydrant is done by any person having a permit and taking water from said hydrant for construction or other uses, the holder of the permit shall pay such damages and all costs and expenses that may be incurred by reason thereof, on demand, to said village.

§ 93-6. Obstructions. 

No person shall place any obstruction that would prevent free access to any fire hydrant or leave any vehicle standing within twenty (20) feet of the hydrant.

§ 93-7. Penalties for offenses. 

Any person violating any of the provisions of this Article shall be liable to a penalty set forth in Appendix C of the Code of the Village of Windsor containing the list of Fines and Penalties for the Village or imprisonment for not more than fifteen (15) days, or both.*
